Terms and Conditions for Gym Owners
Welcome to GymBudd, a web application designed to assist gym owners in managing
operations, memberships, and fitness services. By accessing or using GymBudd, you agree to be bound
by the following Terms and Conditions. Please read them carefully.
1. Account Registration and Access
- Only registered gym owners may access the GymBudd owner dashboard.
- You must provide complete and accurate information during registration.
- You are responsible for safeguarding your login credentials and all activities under your
account.
- GymBudd reserves the right to verify ownership and revoke access for false or misleading
information.
2. Subscription and Payments
- Access requires an active subscription (monthly, annual, or multi-branch).
- All payments are final and non-refundable once the subscription period begins.
- GymBudd may adjust subscription fees with prior notice.
3. Use of Services
- Tools include managing members, instructors, classes, attendance, payments, and equipment.
- QR code scanning is required for attendance tracking.
- Communication is limited to messaging and announcements.
- Use GymBudd solely for lawful gym management purposes.
4. Data Ownership and Responsibility
- You retain ownership of your data.
- You’re responsible for accuracy and legality of information entered.
- GymBudd stores data for operational use but does not guarantee backup beyond system standards.
- We are not liable for data loss due to user error, unauthorized access, or misuse.
5. Security and Acceptable Use
- Do not use GymBudd for fraudulent or unlawful activity.
- Uploading malicious code or disrupting the platform is prohibited.
- Accounts may be suspended for violations.
6. Limitations of Service
- Online payments are not processed — all must be recorded manually.
- Payroll is not managed within the system.
- System tutorials and diet plans are pre-set and non-customizable.
- Only QR code attendance is supported.
7. Service Availability
- Downtime may occur due to maintenance or technical issues.
- Maintenance schedules will be announced when possible.
- Updates may occur without notice to improve services.
8. Intellectual Property
- All rights to software, logos, and documentation belong to GymBudd.
- Reproduction or distribution requires written permission.
9. Termination
- You may cancel anytime; access remains until the billing period ends.
- Accounts may be terminated for violations.
- Data may be deleted or anonymized upon termination.
10. Compliance with Laws
- You are responsible for operating within your local laws and regulations.
- Illegal activity may result in account suspension.
11. Risk and Liability
- GymBudd is not liable for physical operations of your gym.
- You are solely liable for injuries, disputes, or incidents on-premises.
- No guarantees are provided regarding gym success or profitability.
12. Limitation of Liability
- No liability for indirect or consequential damages.
- Maximum liability is limited to six (6) months’ subscription fees.
13. Indemnification
You agree to indemnify GymBudd for any damages or claims arising from:
- a) Use of the system
- b) Violation of these Terms
- c) Violation of applicable laws or third-party rights
14. Dispute Resolution
- Disputes will first be resolved through good faith negotiations.
- Unresolved issues will be arbitrated via PDRCI (Philippine Dispute Resolution Center).
15. Governing Law and Venue
- Terms governed by the laws of the Republic of the Philippines.
- Venue shall be Tarlac City, Philippines.
16. General Provisions
- This document is the complete agreement between parties.
- If one part is invalid, the rest remains enforceable.
- Failure to enforce a provision is not a waiver of rights.
